Jason has extensive experience mediating complex construction matters and commercial and business disputes. His construction and surety law practice includes working with clients at every phase of the construction process. Jason’s mediation clients benefit from that experience and expertise.
In his construction law practice, Jason represents owners and developers, design professionals, general contractors, subcontractors, and material suppliers. He handles everything from contract negotiations at the beginning of a project through project closeout. When disputes arise, he handles litigation matters related to construction defect and delay claims, wrongful termination claims, and liability issues. This experience gives him the ability to view and understand construction disputes from different perspectives and to quickly assess the issues and evaluate the risks. This knowledge also helps him to efficiently mediate multi-party disputes and work with the parties to design a mediation process that maximizes the potential for resolution.
Jason utilizes an active and evaluative approach to mediation and believes the parties benefit from his independent and experienced insight. He strives to quickly and accurately identify the interests that each party in the litigation is seeking to protect. He knows that there is inherent value in the parties having a hand in crafting a resolution, so his goal is to urge the parties to resolve every dispute prior to trial.
In his law practice at Bell, Davis & Pitt, Jason has successfully litigated complex commercial and business disputes involving misappropriation of trade secrets and unfair and deceptive trade practice cases involving multi-million-dollar claims. His trade secrets and unfair competition practice involves covenants not to compete, as well as claims against rogue employees. This experience enables Jason to quickly assess a matter and help the parties to reach a resolution without going to court.
In addition to his mediation practice, Jason regularly serves as an arbitrator. He provides early neutral evaluation (“ENE”) services to help parties focus on the issues in a dispute from the outset and evaluate the merits of the claims. He also provides neutral case management services in multi-party disputes where the parties need the assistance of a neutral facilitator throughout the course of the pending litigation process.
Jason is certified by the North Carolina Dispute Resolution Commission to conduct Superior Court mediations. Since 2008, he has mediated close to 1,000 cases in both state and federal court proceedings, and regularly serves as an arbitrator. Jason has been inducted into the National Academy of Distinguished Neutrals, an invitation-only professional association whose membership consists of highly regarded mediators and arbitrators.
Business North Carolina’s Legal Elite recognized Jason as the 2020 Legal Elite Overall Winner in Construction Law. The Legal Elite regularly lists him in both construction law and business litigation. North Carolina Super Lawyers magazine has included him several times in the Top 25 attorneys in Charlotte and Top 100 attorneys in North Carolina.
